5.BREEDING OF THE DOG

5.1. Seller does not retain any breeding rights.

5.2. This Dog is_______is not_______being sold as a breeding animal. If this Dog is not being sold as a breeding animal, this Dog is being sold as a family pet companion and will not be used for breeding. If this Dog is ever bred either by mistake or design, this contract is void, and will void the hip guarantee.

6.WARRANTIES

6.1 At the option of the Buyer, the Buyer may/must take the Dog to a licensed veterinarian for a thorough exam, the necessary shots, microchip(if not already given) and medication(if needed), within 7 days from the time of purchase. Provided that the Dog is returned to the Seller withing 3 days of purchase, and the Buyer furnishes a signed statement from a licensed veterinarian of a medical problem, a full refund will be given to the Buyer within 3 days of return. This Dog will have first puppy shots and will be wormed. As of this date, the puppy is in good health and free of communicable disease. You will receive the vet medical record of the puppy.

6.2. Seller warranties that the Dog is purebred and that the pedigree is correct and a copy will be provided to the Seller at the time of sale. The Dog is registerable unless the form is withheld as indicated in section 1 above.

6.3. The Buyer understands that the Seller has limited information and control regarding the future temperament, habits, and appearance of the Dog, and hence does not warrant such.
6.4. Seller warrants that the Dog will be free of genetic canine dysplasia and will OFA certify either fair, good,or excellent when the dog is 2yrs old. The hips must be x-rayed by a licensed vet, certified and skilled at producing x-rays for OFA evaluation.
If the hips do not certify fair,good or excellent, a puppy form a subsequent litter, of Seller's choice and of equal value will be made available to Buyer. Buyer will provide proof of spay/neuter of Dog prior to receiving the replacement puppy. The Dog must have hips OFA'd within 2 months of turning 2 yrs old or else the hip warranty is void.

7.TREATMENT OF THE DOG

7.1. Regardless of any provisions in this contract and its Addendum, this Dog is to be kept as a house pet only. Extensive time (alone) in outside areas, garage, or tied up outside in not allowed. The Dog is to be kept in the Buyer's living quarters. The Dog will not be used as an attack dog or guard dog for people, animals, or property.
The Buyer shall provide animal with humane care. If the Dog/Puppy ever shows evidence of abuse or neglect at any time, ownership and title of Dog will revert immediately to Seller.

7.2 It is highly recommended that a professional trainer be consulted to train the Dog and Buyer in the proper handling of the Dog.
7.3. This Dog is never to run off-lead except in a safely enclosed area.
7.4. The Buyer shall provide the Dog with necessary veterinary care upon sickness, disease, or injury, and shall take it to a veterinarian at least once a year for an annual health examination and routine vaccinations.
7.5. If the Dog cannot be kept by the Buyer, the Buyer shall notify the Seller immediately. This Dog may never be sold of given away to any company, research facility, or group, except to Seller.

8.OWNERSHIP OF THE DOG

When ownership is transferred, the Dog's registration certificate is signed over to the new owner of the Dog. Any other transfer of this Dog without written permission of the Seller shall make the Buyer liable for $________in damages, payable upon demand by the Seller. It is understood that this provision is to protect the Puppy/Dog, as we screen our buyers and want to insure out pups are matched to the right family and so that we know where & how our pups/dogs are being kept/raised.

9.GENERAL CONTRACT TERMS

All understanding between the parties are incorporated in this Contract.This contract shall be governed by and construed in accordance with the internal laws of the State of Michigan and without reference to any rules of construction regarding the party responsible for drafting this Contract.
The Dog shall reside at the address stated in section 3 above. Any changes in the Buyer's or Seller's address must be relayed to the other party within 7 days of change.
The singular form of Buyer and Seller includes the plural.
In the event the laws of the state noted above require any other provisions to be included in this Contract to make this Contract compliant with the laws of said state, then said provisions shall be deemed included herin.
If any consent or other approval is needed and is provided for in this Contract, such consent or other approval shall not be unreasonably withheld, delayed or conditioned.
